Sellers Disclosure QLD Pty Ltd (“the Firm”) provides seller disclosure statements and related services in accordance with the Property Law Act 2023 (Qld). While we take all reasonable steps to ensure accuracy and compliance with legal requirements, the information we provide should not be relied upon as a substitute for independent legal, financial, or professional advice.
Legal Advice Disclaimer
Some aspects of our services may involve legal information or assistance provided under the supervision of a Solicitor holding a current unrestricted practicing certificate. However, unless a separate client agreement is entered into, no solicitor-client relationship exists beyond the scope of disclosure services. Legal representation for conveyancing or litigation is not provided by this firm.
Third-Party Search Disclaimer
We rely on third-party providers (such as councils, state authorities, and title offices) for property search results. We do not warrant the accuracy or timeliness of third-party data and are not responsible for delays or inaccuracies caused by those providers.
No Guarantee of Sale or Transaction Outcome
Our services do not guarantee a property sale, buyer approval, or legal compliance beyond the date of disclosure statement preparation. Regulatory changes or new facts arising after completion may impact the accuracy or relevance of the document.
Limitation of Liability
To the maximum extent permitted by law:
1. Liability Cap
The total liability of Sellers Disclosure QLD Pty Ltd, whether in contract, tort (including negligence), under statute or otherwise, arising out of or in connection with the services provided, is strictly limited to the total amount of fees paid by the Client for those services.
2. No Consequential Loss
The Firm is not liable for any indirect, special, incidental, or consequential damages or loss, including but not limited to loss of opportunity, revenue, data, or profits, arising from or in connection with the services or use of our documents.
3. Client Responsibility
The Client is solely responsible for ensuring the accuracy and completeness of all information supplied for preparation of disclosure documents. We are not liable for any errors or omissions resulting from incorrect or incomplete instructions provided by the Client.
4. Reliance on Third Parties
The Firm disclaims any liability arising from inaccuracies in government searches, third-party reports, or external databases.
5. Australian Consumer Law
Nothing in this clause excludes, restricts, or modifies any rights, warranties, or guarantees which cannot be excluded under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law). However, where legally permissible, those rights are limited to the re-supply of the service or a refund of the service fee.
